STATE RESTRUCTURING: Parties at a loss how to handle recommendations

KATHMANDU, FEB 08 -
Major parties are yet to reach a conclusion on procedures to debate the reports of the State Restructuring Commi-ssion in the Constituent Assembly.

The reports were submitted to CA Chairman Subas Nembang by Prime Minister Baburam Bhatta-rai last week. The dispute between Maoists and non-Maoist parties over the amendment to the CA rules of procedures has made the entry of the reports in the assembly uncertain.

The subcommittee led by Maoist lawmaker Amrita Thapa Magar is yet to forge consensus on the amendment to the CA Rules of Procedure. Four non-Maoist members want the reports to be referred to Constitutional Committee after debate in the CA, while coordinator Thapa is for referring them back to the CA Com-mittee on Restructuring of the State and Devolution of State Power.

“We submitted our common opinion on the amendment to the coordinator 10 days ago. I hope we will reach a conclusion by tomorrow [Thursday] afternoon,” said Nepali Congress lawmaker Ramesh Lekhak. Coordinator Thapa has said she needs to talk with the party leadership before approving the recommendation of the members.

The reports of the commission can be referred to the CA for discussion and resolution of contentious issues only after rule amendment, which requires a simple majority of the CA.

Parties are also divided over the way forward if none of the contentious issues garners simple majority required for the preparation of the first draft of constitution. Non-Maoist parties have proposed that the disputed issues be referred back to the Constitutional Com-mittee if none of the proposals secures a simple majority.

Maoists, however, have proposed that one of the two proposals that secures the highest votes in the CA be referred for the second round voting in the full House. It has also stressed that the rule should ensure that none of the lawmakers can remain absent or abstain from voting, using the prime ministe-rial election procedure as the precedent.
