Supreme Court stays move to legalise war-era property deals

The Supreme Court on Thursday stayed the government’s decision to legalise sale, purchase and distribution of property by the “Revolutionary Council” of the Maoist party during the insurgency.
A single bench of Chief Justice Khil Raj Regmi cited gravity of the issue and decided to send the writ petition challenging the decision to the full bench of the apex court. The court said the order will be in effect till January 25. It also gave the defendants 15 days to furnish replies through the Office of the Attorney General. A group of lawyers from the Democratic Lawyers’ Association had filed the writ in the court on Tuesday.
According to the Cabinet decision on the legalisation of the transactions, the Land Revenue Office will endorse the decisions taken by the “people’s government”. The then CPN (Maoist) had operated a parallel government in some hilly districts including Rukum, Rolpa, Salyan and Jajarkot. Over 4,000 copies of land ownership certificates were distributed in Rukum alone. Local Land Revenue Offices have also been told to publish public notices asking people to file applications for legalising the war-time documents within 35 days. However, the Maoists seem reluctant to revoke the decision. “The decision is good, as it was necessary to legalise war-time land transactions,” said UCPN (Maoist) leader and Local Development Minister Top Bahadur Rayamajhi.
