SC seeks govt response

The Supreme Court (SC) has sought clarifications from the government over the disappearance of people in the Nepal Army’s Bhairabnath Battalion and lack of investigation into the same.
The court issued the order on Monday in response to a writ filed by Ram Maya Nakarmi, wife of Padam Narayan Nakarmi- one of the 49 persons who were made disappear from the Bhairabnath Battalion-demanding action against police officers who did not initiate investigation into the incident despite registering an FIR. Ram Maya had filed the FIR at the Metropolitan Police Range, Hanumandhoka on June 19, 2006 demanding investigation into the incident of disappearance and punishment to the culprits.
The apex court has directed the chief secretary to furnish the government’s stand on the incident within 10 days. The court order asks the chief secretary to reply only after gathering information from the concerned ministries or departments as to why the recommendations of National Human Rights Commission (NHRC) on the disappearance at Bhairabnath Battalion have not been implemented yet. Responding to an earlier inquiry, NHRC had told the court that the government has not made sufficient investigation into the case. The Office of the High Commissioner for Human Rights had also released a study report in 2006 recommending that the government make a civilian investigation into the disappearances stating that it was a grave violation of human rights.
