Inter-caste union cash law challenged
KATHMANDU, JUL 04 -
Lawyers have moved the apex court over the government decision of granting a bounty of Rs. 100,000 to each new Dalit-non-Dalit union.
A writ filed by Lawyers’ National Campaign for Elimination of Caste Discrimination on Sunday claimed the regulation concerning the bounty distribution made conflicting statements on the age threshold of the persons willing to marry. The 2009 regulations states in order to be eligible for the incentive, the male and female partners willing to enter inter-caste marriage should be over 22 and 18, respectively. But, this contradicts the marriage chapter of the Muluki Ain, which requires the female to be 18 if the marriage is consented by her parents and 20 if they object to it. For court marriage the partners have to be 20. “The regulations provisions a female can marry at the age of 18 even if her parents do not allow her, provoking people into illegal marriage,” said Prabhaka Bagchand, Bhupendra Raj Adhikari and Anand Koirala in the writ.
