Law flaw makes state poorer

KATHMANDU, MAY 02 -
The government’s failure to amend the District Court Regulations-2052 — incorporate in it an auction provision — has caused the state to lose millions of rupees.

As an authorised body, the Kathmandu District Court (KDC) has over the past decade confiscated 275 motorcycles, 40 cars, a lorry, eight kg of Yarchagumba -- a rare parasitic fungus used for medicine -- and numerous electronic appliances. Besides, vehicles stolen for abduction and smuggled drugs are among the items stored on the court premises. Nevertheless, neither the parliament nor the Supreme Court (SC), has taken any initiative to amend the law to pave the way for auctioning off these items.

Chitra Bahadur KC, Judgment Education Officer at Revenue Department in the KDC, says, “The SC is the body responsible for amending the law. All we can do is wait for a new provision since not a single precedent has been set for this particular issue.”

What’s worse, the courts are not in a position to keep the items safe over a long period of time. “The courts have become congested due to the dumped items,” said KC. For want of space, the KDC has kept 40 of the bikes on the SC premises. These two-wheelers have suffered a lot of damage since. Other seized items have found space at the Trolley Bus Office in Minbhavan, the Road Division Office and the Lalitpur District Court. According to KC, a large amount of Yarchagumba seized in the last few years has turned to dust.

This mismanagement has also made it possible for staffers and outsiders to steal or abuse the property stored. “The more the delay in amending the law, the greater the loss to the government,” said KC.
