Plan for use of infrastructure is no-go

The government's plan to issue licenses to interested companies to build telecom infrastructure that could be shared among service providers has been killed after the Ministry of Law and Justice refused to put the proposal before the cabinet.
The Nepal Telecommuni-cations Authority, the regulator of the telecom sector, had
recommended to the Ministry
of Information and Communi-cations to create a legal provision to permit building of telecom infrastructure.
In response to the authority's recommendation, the Information Ministry had asked the Law Ministry to draw up legal provisions governing infrastructure sharing. However, the Law Ministry did not forward the proposal to the cabinet saying it was not necessary in the present context.
According to a source at the Law Ministry, the Information Ministry had proposed taking to the cabinet a number of provisions from three acts through the Act Amending Some Nepal Acts related to communications. But the subject of issuing licenses to build infrastructure was not forwarded to the cabinet.
The source said that this was decided after consultations with officials from the Information Ministry. "However, the National Broadcasting Act and the Working Journalist Act have been tabled at the cabinet," the source added. Rajendra Nepal, legal officer at the Information Ministry, said that the ministry had not received any authentic information regarding this subject. "We had proposed creating new provisions to permit interested companies to build telecom infrastructure and share it among telecom operators," said Nepal. "If the Law Ministry did not forward this proposal."
