Appellate Court denies bail to Sobhraj

KATHMANDU, JAN 09 - Patan Appellate Court upheld today the order of Kathmandu District Court that Charles Sobhraj be kept in judicial custody for court proceedings on the 1975 murders of two foreign nationals in Kathmandu. A joint bench comprising of judges Rana Bahadur Bam and Girish Chandra Lal made the decision after over three weeks of postponements on the hearing of Sobhraj’s appeal for release on bail.
However, the court ruled out the recovery of a red bag from Soaltee Hotel in 1975 as a basis for Sobhraj’s involvement in the murders. Meanwhile, the report of handwriting experts that Sobhraj’s handwriting has similarities with that of the foreigner who stayed in Soaltee then was held by the court as a plausible basis for suspecting Sobhraj’s involvement.
Similarly, the same bench upheld today the District Court’s order that Sobhraj be released for the Immigration Offence charge filed against him by the Department of Immigration (DoI). DoI had appealed that the District Court’s decision be reversed.
"The denial of the court to grant bail rights to Sobhraj was unfortunate," said Sanjeev Ghimire, Sobhraj’s lawyer. "We will knock the doors of the Supreme Court," he added.Posted on: 2004-01-10 02:39
