Govt appeals against SC rejection to review CA term

KATHMANDU, JAN 27 - Government on Friday registered an appeal against the Supreme Court (SC) refusal to register a review petition on its verdict on the tenure of Constituent Assembly (CA).

On Dec 27, the SC had refused to entertain the application of Legislature-Parliament to review its ruling on the CA term.

According to deputy spokesperson at SC, Hemant Rawal, Prime Minister Baburam Bhattarai filed the appeal through the Office of Attorney General. Earlier, a similar appeal by the parliament was rejected by the SC citing that it would not review its verdic on CA term.

In its application for review of SC ruling, the parliament had argued that the review was necessary to make sure that the judiciary respects the principle of power separation among the trinity of legislature, judiciary and the executive.

On Nov 25, the apex court had issued a verdict putting a cap on the term of the CA. The apex court had issued a directive that gave the government and the CA a “last chance” to extend the assembly’s term by a maximum of six months. The apex court had suggested that a referendum or a fresh mandate or any other constitutional method were alternatives to the CA if it failed to deliver the constitution within the extended deadline.
