Withdrawal depends on cases' merit: CJ

KATHMANDU, SEP 16 - Chief Justice (CJ) Khil Raj Regmi has said that the withdrawal of conflict-era cases will depend on the merit of the case itself. The CJ clarified that the cases may not be withdrawn if they don't deserve merit. Speaking to reporters at his office on Friday, CJ Regmi however stated that the attorney general was the person concerned in clarifying and advising the government regarding the cases' withdrawal. Few days ago, Attorney General Mukti Pradhan had said that the conflict-era cases indicting Maoist leaders and cadres could be withdrawn.

Meanwhile, the CJ stated that the number of backlog cases is declining because of the courts' initiatives although the number increased in the last fiscal year and the problem was compounded due to the retirement of judges.

The CJ also informed that there are 1,428 cases that are older than three years and around 63 percent of the cases in the Appellate Courts have been sorted out.

Stating that the chief judge in the Appellate Court would be made responsible for the overall performance of the courts under their jurisdictions, the CJ informed that those judges would have to report to him on the progress in the court cases, especially the decisions' implementation.  

CJ Regmi said that the apex court has set up a separate team that will look into corruption related cases every Sunday and Tuesday. The CJ said that they were mulling over managing cases based on their nature. On the recommendation of a study team to start evening courts, the CJ said they were considering holding consultations with the stakeholders in the process.
