SC slaps Rs 17.5 m fine, 2-yr jail on Chaturbedi
KATHMANDU, SEP 07 - The Supreme Court on Wednesday sent former managing director of Nepal Oil Corporation and Nepal Airlines Corporation Ramayagya Prasad Chaturbedi to 18 months in jail and slapped a fine of Rs 17.5 million on corruption charges.
Issuing a final verdict on a case, a division bench of Chief Justice Khila Raj Regmi and Sushila Karki also said property worth the same amount be valued as illegally accumulated.
The almost decade-old case is considered one of the high profile corruption cases in the country.
The Commission for Investigation of Abuse of Authority had filed the case in the Special Court against Chaturbedi and his family in 2003 for illegally amassing property worth Rs 77.1 million.
The CIAA had sought a jail sentence of up to five years and maximum appropriation of the illegally earned property. However, the Special Court led by Govinda Parajuli had imposed a fine of Rs 30 million and sentenced Chaturbedi to three years in prison.
Chaturbedi had been evading arrest and he continues to do so.
The Kathmandu District Court (KDC) had been asked to do the needful then. On Wedenesday, the SC again asked the KDC to do the needful.
In its verdict on the case, the Special Court in 2005 had said the valuation has to be done at the rate of the year in which Chaturbedi acquired the property.
The Court had said that the total property owned Chauterbedi was only Rs 25.8 million. The Court also said that only property worth Rs 19 million was illegal.
However, it was proven that Chaturbedi had hidden Rs 11 million in Indian banks.
The CIAA had claimed that Chaturbedi's property was worth Rs 37.1million. However, this could not be established in the court.
Chaturbedi had appealed the Special Court decision in the apex court on June 2, 2005.
