Writ in SC over delay in TRC formation
KATHMANDU, APR 08 -
Demanding immediate formation of two important Transitional Justice (TJ) mechanisms—Truth and Reconciliation Commission (TRC) and the commission on enforced disappearances—a writ has been filed in the apex court against the government and the House on Thursday.
Two bills related to these TJ mechanisms, which were registered more than a year ago, have been pending in the parliament. “The government and the House have been deferring the endorsement of the bills related to TRC and disappearance commission, which is against the spirit of the Comprehensive Peace Accord and the ongoing peace process,” reads the writ. “This is also against the recommendation of the National Human Rights Commission.
An immediate endorsement of the bills related to the formation of these mechanisms should be ensured.” The bills on disappearance and TRC were registered on Dec. 4, 2009.
The writ, jointly filed by Magna Carta Centre, Nepal Chairman Achyut Acharya and advocates Shyam Babu Kafle and Bhim Prakash Oli, has also named the Office of Prime Minister, the Ministry of Peace and Reconstruction, and the Ministry of Law and Justice as defendants.
