Chief Justice for CC meet to name successor
KATHMANDU, APR 04 - Chief Justice (CJ) Ram Prasad Shrestha asked Prime Minister Jhala Nath Khanal on Monday to call a meeting of the Constitution Council (CC) as soon as possible for the appointment of the former's successor.
In a letter, the CJ told the prime minister that the new CJ is appointed by the president, after the Parliamentary Hearing Special Committee (PHSC) conducts a hearing on the new appointee at the recommendation of the CC, according to Article 101 (1) of the Interim Constitution.
"These constitutional procedures take a long time. Therefore, I urge PM Khanal, ex-officio chairman of the CC, to call a meeting of the CC at the earliest," the CJ wrote. "I will stop coming to office the very next day of the nomination of the new CJ." Shrestha will go on leave once his successor is named.
The then senior Supreme Court Justice, Shrestha, who was appointed CJ on March 16 last year, is going to retire on May 6. Khil Raj Regmi, senior-most CJ Justice, is in line for the coveted post.
The constitution requires the PHSC to conduct hearings on nominated CJs at least a week before the incumbent CJ retires. The PM still has to appoint three ministers for the council to convene its meeting.
