Bring gang-rapists to justice: Apex court

KATHMANDU, DEC 02 -

The Supreme Court (SC) on Wednesday issued a mandamus to the government telling it to file a case against all accused involved in the gangrape of a policewoman in Achham District Police Office.

A joint bench of SC justice Bala Ram KC and Bharat Datta Upreti issued an order to the Achham District Attorney Office to file the rape case against Sub Inspector Dan Singh Bhandari, Head Constable Bira Dutta Badu and Constable Nariman Mahattara.

On Sept. 29 last year, the district attorney office had filed a case against only Head Constable Birendra Bam, Karbir Thalan and Constable Jagdish Panday.

The Achham District Court has kept them in the police custody for further investigation. The District Police office had released three other accused— Bhandari, Badu and Mahattara stating that it lacked adequate evidence to arrest them.

In February this year, the policewoman filed the case against the trio who were released—demanding that they be prosecuted as well.

The SC also said that there was no need to abide by the 35-day deadline to file the case relating to this particular incident.  Apart from the policewoman’s writ, on behalf of her Women Rights Defenders had filed two writs against the trio.

“I was tired of not getting justice, but I am hopeful of it now,” said the victim. A native of Darchula, she has been in the Achham district police for the last six years.

Following the incident, she has been living in Kathmandu and is under treatment for uterus infection.

Hearing another writ filed by an advocate Jyoti Lamsal on behalf of the victim, the SC also issued directives to the government to amend the law for the welfare of women.
