Court to govt: Define children
KATHMANDU, JAN 27 - The Supreme Court on Wednesday issued a show cause notice to the government asking for a clear definition of 'children'. A single bench of Chief Justice Anup Raj Sharma issued the order in response to a litigation that stated Nepal's laws have defined children variously, making the definitions inconsistent with international child right laws, including UN Convention on the Rights of the Child.
Children Act 1992 and Act Against Human Trafficking 2008 have defined children as persons under the age of 16 and 18 respectively.
The litigants had claimed that conflicting definitions in the laws could jeopardize the rights of children of age between 16 and 18, as they could be deprived of the facilities and rights guaranteed by the Interim Constitution, which does not mention the defining age.
The litigation was filed on Jan. 11 by advocate Bal Krishna Mainali demanding a court intervention, which would pave the way for a single definition of children in all laws.
